RE: The tariff classification of Ferric Citrate (CAS-3522-50-7) in bulk powder form, from India
Dear Ms. Forstenzer:
In your letter dated November 22, 2013, you requested a tariff classification ruling.
The subject product, Ferric Citrate, is also known as 1,2,3-Propanetricarboxylic acid, 2-hydroxy-, iron(3+) salt. It is currently undergoing phase 3 clinical trials for the treatment of hyperphosphatemia, kidney failure.
The applicable subheading for the Ferric Citrate imported in bulk powder form, will be 2918.15.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Carboxylic acids with additional oxygen function and their anhydrides, halides, peroxides and peroxyacids; their halogenated, sulfonated, nitrated or nitrosated derivatives: Carboxylic acids with alcohol function but without other oxygen function, their anhydrides, halides, peroxides, peroxyacids and their derivatives: Salts and esters of citric acid: Other.” The rate of duty will be 3.7% ad valorem.

Articles classifiable under subheading 2918.15.5000, HTSUS, which are products of India, may be entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
